Dean of Rota warns Pope could strip Card. Burke & others of cardinalate

Archbishop Pio Vito Pinto, Dean of the Roman Rota, told a conference in Spain that Cardinal Burke and the three cardinals who submitted the dubia to Pope Francis “could lose their Cardinalate” for causing “grave scandal” by making the dubia public. The Dean of the Roman Rota went on to accuse Cardinals Raymond Burke, Carlo Caffarra, Walter Brandmüller and Joachim Meisner of questioning the Holy Spirit. Archbishop Pio Vito Pinto made his astounding accusations during a conference to religious in Spain.

Archbishop Pio Vito’s indictment against the four cardinals, and other people who question Pope Francis and Amoris Laetitia, was that they not only questioned one synod of bishops on marriage and the family, but two synods, about which, “The action of the Holy Spirit can not be doubted.”.

The Dean of the Roman Rota went on to clarify that the Pope did not have to strip the four senior cardinals of their “cardinalate”, but that he could do it. He went on to confirm what many commentators have suspected that Pope Francis’ interview with Avvenire, the newspaper of the Italian bishops, was the Holy Father’s indirect response to the cardinals’ dubia:

During the conference, Pius Vito made clear to those present that the Pope did not respond directly to these four cardinals, “but indirectly told them that they only see white or black, when there are shades of color in the Church.”

The Dean of the Roman Rota, the highest canonical court responsible for marriage in the Catholic Church, went on to support Pope Francis’ innovation of allowing divorced and “remarried” to receive Holy Communion. In response to a question asking if it was better to grant divorced and civilly remarried couples nullity of marriage so they can marry in the Church before they receive Holy Communion Archbishop Pio Vinto expressed preference for Pope Francis’s “reform”:

Pope Francis’ reform of the matrimonial process wants to reach more people. The percentage of people who ask for marriage annulment is very small. The Pope has said that communion is not only for good Catholics. Francisco says: how to reach the most excluded people? Under the Pope’s reform many people may ask for nullity, but others will not.


The Dean of the Roman Rota appears to be overlooking the canonical rights of the faithful, including cardinals, to make their concerns about the state of the Church known to the people of God. Can. 212 §3 sets out this solemn right and duty:

According to the knowledge, competence, and prestige which they possess, they have the right and even at times the duty to manifest to the sacred pastors their opinion on matters which pertain to the good of the Church and to make their opinion known to the rest of the Christian faithful, without prejudice to the integrity of faith and morals, with reverence toward their pastors, and attentive to common advantage and the dignity of persons. (Can. 212 §3).

Cardinals Burke, Caffarra, Brandmüller and Meisner expressed due respect to Pope Francis and his “sovereign decision” not to respond to their dubia, while at the same time meeting their right and duty to communicate with the People of God. For the Dean of the Roman Rota to warn the four cardinals that they could be stripped of their cardinalate for acting in accord with the law of the Church is oppressive.

    I just hope that they are not deterred in their resolve to take this to the next level; that is, some kind of formal correction of the errant opinions of (or regarding) Amoris Laetitia.

  9. Whatever happened to Pope Francis’ repeated call for us all to be non judgemental?

    He tells us we must accept the sins of others, we must allow adulterers to receive Holy Communion, we must not judge those who live the homosexual lifestyle. Yet, if fellow clergy respectfully ask him to clarify some points that are causing grave scandal to the Church, and he ignores them so they make their letter public, he then comes down on them, through various henchmen, like the proverbial ton of bricks.

  10. If someone has a “rigid” orientation and adopts a rigid lifestyle but is following his conscience and his own idea of the good, who am I to judge? It is important that we accompany those with the rigid condition in their walk with Christ as they discern the spirit, so that they can fully participate in the ecclesial community, as part of a gradualism approach to the orientation of rigidity and neo-Pelagian triumphalism. We don’t want to return to the days when rigidtarians had to hide in a ghetto for fear of having their rigidity, neo-Pelagian triumphalism, and nostalgic pious devotions and traditions exposed and ridiculed by judgmental modernists and progressive revolutionaries who were not always welcoming of the stranger and the other. Or when they had their heads chopped off by the Protestant King and Queen of England.

  11. I wonder if this threat by the Archbishop is also meant to be a shot across the bow to those who would be inclined to go public in support of the Magnificent Four, especially any bishops who are ordinaries of dioceses.

  12. Once again, ZERO reasons given, whether theological or otherwise. It’s all more of the same: Pray (if you like), Pay (even if you don’t like) and Obey (unless you are more Modernist than we are, in which case, keep forwarding the revolution against Christ; we’ll ratify it for you later).
    Monsignor Vito, since you are Dean of the Sacred Roman Rota, you are supposedly a trained lawyer, and thus ought to habitually think and communicate with logical arguments.
    Would you be so kind as to answer a few questions?
    1) WHERE does the Church teach that synods are necessarily guided by the Holy Spirit?
    2) HOW do you know, even assuming that were true (which you can’t prove, because it isn’t), that what Pope Francis wrote in “Amoris” Stultitia actually reflects that guidance?
    3) WHAT scandal has actually been given, and how?
    And finally, could you please give us the one answer we really need above all?
    4) If your precious synods, and your pope Francis, are infallible in everything they say…
    WHY are not previous synods — and a fortiori ecumenical councils — and popes, not also infallible in everything they say?
    Of course, we both know that you won’t go there, because if you do you will run straight into the problems already pointed out in the Dubia. You will get called out on the fact that Mortis Tristitia in several points directly and 180 degrees contradicts doctrine previously defined by the Church. What’s worse, the heresy of Universal Papal Infallibility will be exposed for what it is.
    What will you and Francis do when your only shield is ripped from your hands?
    You are a most shamefully unworthy successor of Cdl. Burke. Now there is a real logical thinker. That’s why the tyrant Judas pope Francis had to take him out of the way. Too bad that strategy is presently backfiring on him. I guess he didn’t realize that Burke, besides logic, also has cojones.
    You know, you don’t HAVE to follow Judas’ example. You don’t HAVE to dive into the everlasting flames of hell. No kidding, it’s actually avoidable. You just have to do one thing: Start trying to love Truth a little bit more than yourself…and keep on trying.
